REGARDING: PROHIBITION OF RESALE AND INTELLECTUAL PROPERTY RIGHTS

This Legal Notice serves to formally inform all individuals, entities, and organizations ("Users") who access, purchase, or otherwise obtain digital products ("Products") from Vixabyte ("Company"), of the Company's exclusive rights and the strict limitations placed on the use of its Products.

1. INTELLECTUAL PROPERTY OWNERSHIP
All Products sold by the Company, including but not limited to digital files, software, templates, designs, e-books, audio, video, and any other digital content, are the sole and exclusive intellectual property of Vixabyte . These Products are protected by applicable copyright and intellectual property laws. All rights are expressly reserved by the Company.

2. GRANT OF LIMITED LICENSE
By purchasing a Product, the User is granted a personal, non-exclusive, and non-transferable license to use the Product for its intended purpose . This license is strictly for personal or internal business use, as explicitly described by the Company at the point of sale.

3. EXPRESS PROHIBITION OF RESALE AND DISTRIBUTION
The User is expressly prohibited from:

  1. Reselling, re-licensing, or sublicensing the Product or any of its components to any third party.

  2. Redistributing, sharing, or making available the Product, or its source code, files, or content, to any person or entity other than the User.

  3. Reproducing, duplicating, copying, or creating derivative works based on the Product for commercial purposes, including for the purpose of selling a competing product .

  4. Any unauthorized use, reproduction, or redistribution is strictly prohibited and constitutes a violation of the Company's intellectual property rights and a breach of the license agreement .

4. LEGAL CONSEQUENCES OF VIOLATION
Any violation of these terms, including the unauthorized resale or distribution of the Products, will be considered a material breach of the User’s license and an infringement of the Company's intellectual property.

Should the Company become aware of any such unauthorized activity, it will take all necessary steps to protect its rights. This may include, but is not limited to:

  1. Immediate Termination of Access: Revocation of the User’s license and termination of access to the Product and any related services without refund .

  2. Legal Action: The Company reserves the right to pursue all available legal remedies, including filing a lawsuit for copyright infringement and breach of contract in a court of competent jurisdiction. The Company will seek all available relief, which may include:

    • An order for the infringer to cease and desist all unauthorized activities .

    • An award for monetary damages, which may include the Company's lost profits and/or the infringer's profits attributable to the infringement.

    • Recovery of all costs and reasonable attorney's fees incurred in enforcing these rights .

5. NO WAIVER OF RIGHTS
The failure of the Company to enforce any right or provision of this notice shall not be deemed a waiver of such right or provision in the future.

6. ACKNOWLEDGMENT
By purchasing or using any Product from Vixabyte , the User acknowledges that they have read this notice and understand and agree to be bound by the license terms and restrictions contained herein.
